We prefer that you enter into a legal contract with us upon agreeing on a plan for website development, hosting, or both.

This agreement is between iMMages Web Designs(us), and the authorized person (you) placing an order for this hosting account:

1. Subject to the provisions on this page, the account will be opened after we receive your order and will be billed either monthly, quarterly or yearly (according to the terms agreed upon in advance) unless cancelled by you or us. One month advance notice is required. Payees will be discounted one month if paid one year in advance. Past due amounts may incur a 5% additional charge per month. Any fees not paid in full within three months of billing date (unless prior arrangements are made) will result in the cancellation of services (website will be taken off server).
    
2. Charges are billed on the first of each month for that month's hosting.
    
3. We are allowed, with 30 days written notice, to change our rates for any future server usage and/or services.
    
4. You agree to use our services at your own risk if you maintain your own site. We will backup your data on a weekly basis and will restore your data in the event of a server loss (an additional $5 per month will be added to your server fees for this service). You are responsible to maintain backups of your own material in the event you damage or lose files on your server space. If you host your site on your own server we will provide weekly back-up free if we maintain your site.
    
5. Legal mumbo-jumbo: iMMages Web Designs specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall iMMages Web Designs be liable for any loss, or loss of data, or any other damages. User agrees to protect and indemnify iMMages Web Designs against any and all liability, loss, or expense arising from claims of libel, unfair competition, unfair trademarks, trade names or patents, violations of rights and privacy and infringement of copyrights and property resulting from User's use of iMMages Web Designs services.
    
6. We reserve the right to cancel any account, at any time, without notice, for any reason we consider inappropriate. Use of the email system to send unsolicited email (a.k.a., SPAM) or Usenet postings is not allowed from any of our accounts. "Sexually Explicit Adult Content" is not allowed on our servers. ( See our acceptable use policy! )
    
7. You agree not to use disk space provided by us for uploading files not directly related to your web site (we are not an offsite file-storage facility). You agree not to store any archival files in the disk space on on our servers. 90% of files stored on the servers must be linked to the web site. Web sites designed to distribute software and/or multimedia files are subject to special pricing.
